2.   Against Special Supplemental Nutritional Program for Women, Infants and Children (WIC). This could have been full funded by one week of Bush’s tax cuts for millionaires.

3.   Against National Public Radio. (One could wonder if they  would like to replace it with FOX news?)

4.   Against Desegregation. Check out Minnesota

5.   Against High-Speed Rail. Wisconsin, Ohio and Florida all came out against these improvements.

6.   Against Marriage Equality and the Anti-Gay Agenda.

7.   Against Net Neutrality. They want corporations to control the internet to better their profits and content.

8.   Against Obama. No surprise, but the birther argument goes on and on as well as opposing anything Obama wants; do anything to get rid of him.

9.   Against Unions and Collective Bargaining/against middle class. This is really class warfare ignoring that when unions are strong the middle class is strong and it converse.

10.Against Immigration. Arizona and Texas led this to the point of encouraging vigilantism.

11.   Against Child Labor Laws. Sen. Mike Lee of Utah says it is unconstitutional ignoring the Labor Standards Acts of 1938.

12.Against the right to Vote. All the ID stuff and college students.

13.Against Islam/Islamophobia.

14.Against the Federal Government (Tentherism).

15.Against Gun Control. Let’s let them hit the bars packing concealed weapons.

16.Against Science, the Environment and Health.

17.Against Education/Historical Revisionism. All the creationism stuff, also defunding Head Start, cutting teacher’s pay,


There is a lot the Tea Party is against. What are they for? It appears like they would like to return to the 19th century. Read some history and see what a mess that time was. It also seems important to make no distinction between the country founded in 1776 and our current country.


Nihilism if the belief that a society’s political and social institutions are so bad they should be destroyed. They seem to have this belief as was advocated by the 19th century Russian Party.


While I appreciate the Tea Partys frustration with government and the status quo there agenda seems lets just make things worse. They seem to lack compassion for fellow human beings and would take us back to the law of the jungle or the survival of the fittest. The claim Christian traditions but do not follow Christian ethics of compassion, care and love for their fellow human beings. They have unwittingly become the pawns of big businesses and those who promote inequality in government and economics.

Briefs Filed by Petitioner and His Amici in Bowman v Monsanto



In Bowman v. Monsanto, the Supreme Court will have the opportunity to address the extent to which the doctrine of patent exhaustion applies to progeny of patented recombinant seeds. For background on the case, see this previous post.

Here are links to briefs recently filed by petitioner Bowman and his amici, with some brief commentary:

Petitioner (Vernon Bowman) argues that an authorized sale of recombinant seeds exhausts patent rights in progeny seeds that were not themselves the subject of an authorized sale. He bases this argument on a theory that subsequent generations of seeds are "embodied” in the first-generation authorized seeds.  Bowman is apparently attempting to leverage the Supreme Courts questionable use of the term "embodies" with respect to method patents in Quanta.  He also argues that production of progeny seeds does not constitute "making" the seeds because the use of genetically modified seeds inherently results in the production of progeny seeds. Bowman contends that contract law provides adequate remedies to owners of patents on self-replicating technologies.

Center for Food Safety argues that extending patent exhaustion to progeny seeds will benefit farmers by curtailing Monsantos patent enforcement actions targeting farmers. The Center also claims that extending the patent exhaustion doctrine in this way will benefit scientific research and innovation in agriculture, and lower the cost of farming. The Center further contends the Federal Circuits decision is contrary to Quanta, and reiterates petitioners argument that producing progeny seed constitutes use of the patented seed, not making it, and hence falls within the scope of patent exhaustion. The amici voice is concerned that farmers whose fields have been "contaminated” by Monsantos patented seeds could be subject to infringement lawsuits.

The American Antitrust Institute argue that the Federal Circuits decision is contrary to Supreme Court precedent, particularly Quanta, and departs from long-standing Congressional patent policy.  They warn that the Federal Circuits decision "portends dangerous unintended consequences" for other industries, particularly the computer software industry. They suggest that Monsanto should learn from the software industry, and engage in "effective product differentiation and efficient third-degree price discrimination" in order to counter the threat posed by the ease with which their products can be replicated. They contend that Monsanto could have avoided its need to rely on patents by not working with soybean seeds and other inbred seed lines, and confining their activities to hybrid seeds (i.e., corn) that do not produce true copies of themselves. Somewhat surprisingly, the Institute suggests that Monsanto "could have developed its ‘terminator’ gene, which would have rendered progeny seeds sterile." “Terminator” is a pejorative term for Genetic Use Restriction Technology (GURT), highly controversial technology that Monsanto pledged not to use in 1999.

Knowledge Ecology International essentially argues that effective patent protection is not necessary for self-replicating genetically engineered crops, because "a plethora of alternative mechanisms to patent regimes exist to reward research and development."  For example, they argue that an inventor "can still protect his investment through contractual agreements governing post-sale uses” (while at the same time acknowledging that contract law would not have helped in this case, due to a lack of privity between Bowman and Monsanto).  The plethora of alternative mechanisms includes "sui generis systems of rewards or cash innovation inducement prizes," which KEI characterizes as "viable alternatives to the patent system."  They voice concern that "even plants exhibiting the genetically modified trait found in the wild as a result of cross-pollination, would fall under the patent rights the patent holder.)

The Public Patent Foundation expresses concern that under the Federal Circuits ruling, "contaminated farmers are infringers," and "Monsantos customers routinely make and sell new infringing articles." In a previous post, I discussed a lawsuit that the Public Patent Foundation has filed against Monsanto on behalf of a variety of groups including associations of organic farmers.

Birchbox vs Ipsy A One Year Analysis by the Numbers


There are a lot of beauty box subscription services out there and they all bring something different to the table. Two of the most oft-compared are Birchbox and Ipsy, likely because they both cost $10 a month. I have now received 15 Birchboxes and 14 Ipsy bags, so it seemed like an opportune time to get into a nitty gritty comparison.

However, I quickly realized that there were a lot of different ways I could approach this comparison. I chose the four ways that I thought would be the most valuable for anyone who is trying to decide if they should join Ipsy or Birchbox. The following sections include:
  1. Test 1 - A t-test comparing the estimated retail values of the two boxes.
  2. Test 1 - A similar t-test where the products that were not valuable to me, personally, were eliminated.
  3. An addendum to Tests 1 and 2 that considers the value of points.
  4. Test 3 - A Chi-square test examining what happens if the two boxes simply go head-to-head.
  5. Test 4 - A comparison of the products I actually purchased after sampling them.
  6. My subjective thoughts and conclusions.
WHICH ONE?

Test 1 - Raw Value

The Description:  I calculated the value of my Birchbox and Ipsy the same way that I do every month based on approximate retail value. For example, if a full size product is 1 oz and retails for $30, a 0.25 oz sample would have an approximate retail value of $7.50. I then did a t-test to determine whether Ipsy or Birchbox sends out boxes with higher retail values.
The Benefits: Its an objective test. It could be re-created by anyone. There is no part of this test that is based on how I feel about the box, so if our preferences are different, this test would still be applicable to you.
The Disadvantages: Any of you who have gotten subscription boxes already know that youre probably going to get shit that cant use, at least some of the time. Someone could send me a bottle of Chanel Foundation, but if you send it to me in "Tawny Beige" its disingenuous to pretend that its worth $65 because I cant use it.

T-test Comparison:
A t-test showed that the difference between the two services was extremely statistically significant, t(27)=4.25, p=0.0002. Ipsy tends to send out boxes that have higher retail values, and that difference is robust. 

Test 2 - Personal Value         
 
The Description: This test is similar to Test #1, except that I eliminated the products that didnt add value to my box. A product added value if I was glad to have received it. A product I wanted to try would add value (even if I didnt end up liking it). A product I didnt expect to like but ended up enjoying would also add value. As a side note, I am only including products that gave me value outside of blogging. For example, it was a Juice Beauty product I received from Birchbox that originally inspired my "Beauty Bullshit" series. For the purposes of this test, that doesnt count as value (even though I hope those posts are valuable!).
The Benefits: This test takes into account the fact that subscription services are sometimes going to send out crap without asking me to come up with subjective values for products.
The Disadvantages: There is no objective measure for "crap". There is someone out there who likes products that I hate. If you have a different idea about what is crap, you may find that your results are different. I can only tell you what I didnt like and didnt use.
